Available evidence that establishes sufficient initial likelihood to proceed further, but that may later be displaced by further stronger evidence of alternative facts.

Preference share dividends are prima facie cumulative

"Where preference shares provide for a preferential right in respect of a dividend, the dividend is prima facie cumulative so that the dividend is rolled up and any outstanding unpaid or undeclared dividend becomes payable in priority to a dividend on ordinary shares when distributable profits become available."
